Agreement to Terms
These Terms of Service ("Terms") govern your use of Tachyon's game save synchronization service ("Service") operated by Tachyon ("we," "our," or "us"). By accessing or using our Service, you agree to be bound by these Terms.
If you disagree with any part of these Terms, you may not access or use our Service. These Terms apply to all visitors, users, and others who access or use the Service.
By creating an account or using our Service, you represent that you are at least 13 years old and have the legal capacity to enter into this agreement.
Beta Service Disclaimer
Tachyon is currently offered as a beta service. This means:
- Free Access: The Service is provided free of charge during the beta period
- Feature Development: Features may be added, modified, or removed without advance notice
- Service Availability: We may experience downtime, service interruptions, or data inconsistencies
- Feedback Welcome: Your feedback and bug reports help us improve the Service
- No Service Level Agreements: We do not guarantee uptime, performance, or data availability during beta
While we work diligently to maintain service quality and data integrity, beta software inherently carries higher risks than production software. You acknowledge and accept these risks by using our beta Service.
Description of Service
Tachyon provides game save file synchronization and management services, including:
Core Features
- Automatic Game Detection: Detection and configuration of installed games from various platforms
- Save File Synchronization: Cross-device synchronization of game save files via secure cloud storage
- Timeline Management: Creation and management of separate save timelines for different playthroughs
- Backup and Recovery: Automatic backup of save files with recovery capabilities
- Conflict Resolution: Tools to resolve synchronization conflicts between devices
Platform Support
Our Service currently supports games from Steam, Epic Games Store, GOG, and DRM-free installations on Windows and Linux platforms. macOS and Steam Deck support are in development.
User Accounts and Registration
Account Creation
To use our Service, you must create an account by providing:
- A valid email address
- A secure password
- Acceptance of these Terms and our Privacy Policy
Account Security
You are responsible for:
- Password Security: Maintaining the confidentiality of your account credentials
- Account Activity: All activities that occur under your account
- Unauthorized Access: Immediately notifying us of any unauthorized use of your account
- Accurate Information: Providing and maintaining accurate account information
Account Termination
You may delete your account at any time through the Service interface or by contacting support. We may suspend or terminate accounts that violate these Terms, with or without notice, depending on the severity of the violation.
Acceptable Use Policy
Permitted Uses
You may use our Service to:
- Synchronize your legitimate game save files across your own devices
- Create and manage multiple gameplay timelines
- Backup and restore your game progress
- Provide feedback and report bugs to help improve the Service
Prohibited Activities
You agree not to use our Service to:
- Cheating: Gain unfair advantages in online multiplayer games
- Piracy: Circumvent game copy protection, DRM, or share copyrighted game content
- Abuse: Overload our systems, attempt denial-of-service attacks, or otherwise abuse our infrastructure
- Reverse Engineering: Attempt to reverse engineer, decompile, or hack our Service
- Malicious Content: Upload viruses, malware, or other malicious files
- Legal Violations: Engage in any illegal activities or violate applicable laws
- Third-Party Violations: Violate game publishers' terms of service or platform rules
- Misrepresentation: Impersonate others or provide false information
Data and Content
Your Data
You retain ownership of your game save files and personal data. By using our Service, you grant us:
- Processing Rights: The right to process, store, and synchronize your save files as necessary to provide the Service
- Technical Operations: The right to perform technical operations like backup, recovery, and conflict resolution
- Service Improvement: The right to analyze anonymized usage patterns to improve our Service
Data Responsibility
While we implement robust backup and security measures:
- Personal Backups: You remain responsible for maintaining your own backups of important save files
- Data Export: You can export your data at any time through our Service interface
- Service Limitations: We provide the Service "as is" without guarantees of perfect data preservation
- Account Deletion: Deleted accounts and associated data cannot be recovered
Data Retention
We retain your data as described in our Privacy Policy. Inactive accounts may be deleted after reasonable notice. Upon account deletion, your personal data is removed, though some anonymized analytics may be retained for service improvement.
Intellectual Property
Our Rights
The Tachyon service, including our software, interface, documentation, and trademarks, is owned by us and protected by intellectual property laws. You may not:
- Copy, modify, or distribute our software without permission
- Use our trademarks or branding without authorization
- Create derivative works based on our Service
- Remove or modify copyright notices or attribution
Third-Party Content
Game save files may contain content owned by game publishers. You are responsible for ensuring your use of our Service complies with applicable game licenses and terms of service.
Service Availability and Performance
Service Reliability
We strive to provide reliable service but cannot guarantee:
- Uptime: Continuous availability without interruptions
- Performance: Specific response times or sync speeds
- Compatibility: Support for all games or future game updates
- Data Integrity: Perfect preservation of all data in all circumstances
Maintenance and Updates
We may perform maintenance, updates, or improvements that temporarily affect service availability. We will provide advance notice when possible, but emergency maintenance may occur without warning.
Disclaimers and Limitation of Liability
Service Disclaimers
Our Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including:
- Warranties of merchantability or fitness for a particular purpose
- Warranties of non-infringement or error-free operation
- Warranties that the Service will meet your requirements
- Warranties of data accuracy, reliability, or completeness
Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for:
- Data Loss: Loss of save files, game progress, or other data
- Game Issues: Game corruption, incompatibility, or performance problems
- Service Interruptions: Downtime, sync failures, or service unavailability
- Indirect Damages: Lost profits, business interruption, or consequential damages
- Third-Party Actions: Actions by game publishers, platform operators, or other third parties
Our total liability to you for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim (which is $0 during the free beta period).
Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:
- Your use of our Service in violation of these Terms
- Your violation of any third-party rights or applicable laws
- Any content you upload or sync through our Service
- Your account credentials being compromised due to your actions
Future Pricing and Service Changes
Beta to Paid Transition
When our beta period ends, we may introduce paid subscription plans. We will:
- Provide at least 60 days advance notice before introducing any charges
- Offer options to export your data before any paid transition
- Maintain a reasonable free tier for basic usage
- Honor any promotional pricing or commitments made during beta
Service Modifications
We reserve the right to modify, suspend, or discontinue our Service with reasonable notice. For significant changes affecting your data or core functionality, we will provide advance notice and data export options.
Dispute Resolution
Informal Resolution
Before pursuing formal legal action, please contact us at [email protected]to attempt to resolve any disputes informally. We commit to responding within 30 days and working in good faith to reach a mutually acceptable resolution.
Formal Dispute Resolution
If informal resolution is unsuccessful, any disputes arising from these Terms or your use of our Service will be resolved through:
- Binding Arbitration: Individual disputes (not class actions) may be resolved through binding arbitration
- Small Claims Court: You may pursue claims in small claims court if they qualify under applicable jurisdictional limits
- Injunctive Relief: Either party may seek injunctive relief in court for intellectual property violations or urgent matters
Class Action Waiver
You agree that any arbitration or legal proceeding shall be limited to the dispute between you and us individually. You waive any right to participate in class action lawsuits or class-wide arbitrations.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to conflict of law principles. Any legal proceedings not subject to arbitration shall be brought exclusively in the courts of the Province of Ontario, Canada.
General Provisions
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
No Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
Force Majeure
We shall not be liable for any failure or delay in performance of our Service due to events beyond our reasonable control, including but not limited to:
- Natural disasters (earthquakes, floods, fires, storms)
- War, terrorism, civil unrest, or government actions
- Pandemic, epidemic, or public health emergencies
- Internet or telecommunications outages not caused by us
- Third-party service provider failures (cloud services, CDNs)
- Cyber attacks, hacking attempts, or security breaches beyond our control
- Labor strikes, shortages, or disputes
During such events, we will make reasonable efforts to restore service and communicate with users about expected timelines for resolution.
Changes to Terms
We may update these Terms from time to time to reflect changes in our Service, legal requirements, or business practices. When we make changes:
- We will update the "Last updated" date at the top of these Terms
- We will notify you of significant changes via email or through our Service
- For material changes, we will provide advance notice and may require your acceptance
- Continued use of our Service after changes become effective constitutes acceptance
